Teacher’s 30-Day Sentence For Raping 14 Year-Old Student Overturned

The Montana Supreme Court has overturned a 30-day sentence of former Billings high school teacher Stacey Rambold for the rape of a 14-year old student. The decison means he will serve a minimum sentence of two years in prison.

The Court also ordered that Rambold be sentenced by a new judge.

Yellowstone County District Court Judge Baugh, in a sentencing hearing in August of 2013, described the victim as “a troubled youth, but a youth that was probably as much in control of the situation as (Rambold), one that was seemingly, though troubled, older than her chronological age.”

The court’s decision cited District Judge Baugh’s suggestion that the young victim shared responsibility for her rape.

Victim Cherice Moralez committed suicide in 2010 before the case went to trial, an act her mother claims was driven largely by the rape.

Prosecutors for the state argue that Rambold should serve a mandatory minimum of four years in prison. Rambold attorneys argue the sentence he received was appropriate.

The Judiciary Standards Commission issued a complaint against Baugh and with the state Supreme Court, which is pending. Justices say that will be dealt with separately.
